SC shuts contempt case against Baba Ramdev, Acharya Balkrishna in Patanjali misleading ads case

In great relief to Baba Ramdev and Acharya Balkrishna, Supreme Court The contempt case against them in the Patanjali misleading advertisement case was closed on Tuesday. The case is based on a plea filed in 2022 by the Indian Medical Association (IMA) alleging a smear campaign by Patanjali against the Covid vaccination drive and modern systems of medicine.

“The court has closed the contempt proceedings based on the undertakings given by Ramdev, Balkrishna and Patanjali Ayurved Ltd“said lawyer Gautam Talukdar, who represented yoga guru Balkrishna and the company.

On May 14, the top court had reserved its order on the contempt notice.

Comparison between SC and IMA:
During the last hearing, the top court had asked the medical body’s president RV Asokan whether his unconditional apology to the top court for his “prejudicial” remarks in an interview given to PTI had been published in all the newspapers that had published his interview. In the interview given to PTI, where he had responded to questions on the Patanjali Ayurved Ltd misleading advertisement case, Asokan had said that it was “unfortunate” that the Supreme Court had criticised the association and also some of the practices of private doctors.

The court also observed that the apology should be published in newspapers by Asokan personally and not with IMA funds.

Patanjali vs. Supreme Court:
The case revolves around Patanjali Ayurved, a company that sells herbal products that it claims treat several serious diseases, while criticizing other systems of medicine through its advertisements.

The Indian Medical Association had filed a suit alleging a smear campaign by the company against modern medicine. Despite promising the apex court that it would not violate any law relating to advertising or branding of the products it manufactures and markets, the company violated it, leading to the initiation of contempt proceedings.

Following orders, Ramdev and Acharya Balkrishna had earlier tendered an unconditional apology regarding the misleading advertisements of Patanjali Ayurveda and said they are committed to always uphold the majesty of law and justice.
