Maneka Gandhi received a major blow from the Allahabad High Court

Maneka Gandhi: Former BJP MP from Sultanpur Maneka Gandhi has been dealt a major blow by the Allahabad High Court. The Lucknow bench of the High Court has dismissed the petition filed by Maneka Gandhi against Samajwadi Party’s Rambhual Nishad in the 2024 Sultanpur Lok Sabha elections. The court has held this petition as violating the deadline and against Sections 81 and 86 of the Representation of the People Act, 1951.

Petition was filed regarding criminal cases.
Maneka Gandhi had said in her petition that a total of 12 criminal cases are pending against Rambhual Nishad. While in the affidavit filed on the occasion of the elections she had mentioned only eight cases. She also said in her petition that not disclosing or hiding criminal history cases in the affidavit amounts to corrupt practices.

The request was hampered by the time limit.
The High Court dismissed Maneka Gandhi’s petition saying that her petition was barred by limitation. Let us tell you that this was filed seven days after the 45-day period provided for in the Representation of the People Act, 1951. So the High Court dismissed the petition. Let us tell you that as per Section 81 of the Representation of the People Act, 1951, it is said that a petition challenging any election must be filed within 45 days of the declaration of election results.
