This section has a provision of imprisonment along with fine. In such a situation, if unfortunately such an incident happens with someone, it can be very difficult.
What does section 125(A)/106 BNS say?
Under Section 106 (Section 125-A) of the Indian Penal Code, if any person does any such act without thinking or negligence, which causes the death of a person, then he is punished. This case does not come under the category of unintentional murder and he can be sentenced to up to 5 years and a fine can also be imposed. There are different circumstances in this too, which include negligence during medical, negligence during driving, etc. There is a provision for different punishment in every case.
But if someone is harmed or dies due to your negligence, there is a provision of jail. For example, if a flower pot kept in your balcony falls on someone or an AC falls like in the case of Delhi, then it can be a problem. Accidents caused by these will be counted as negligence. Along with this, if the AC is kept outside the boundary of the house, then action can also be taken for encroachment.
