High Court: The Bombay High Court has taken a significant decision on Wednesday. The court has said that if someone continuously pursues a girl to express his love for her, it will be considered tantamount to sexual harassment. The court has given this decision during the hearing of a case. The Nagpur bench of the High Court said that continuously harassing the girl and claiming that she will accept her love shows that the intention of the harasser is not good. The court said that this would fall under the ambit of sexual harassment under the POCSO Act. High Court judge Govind Sanap upheld the decision of an Amravati court on February 4, 2021.

According to a report by Live Law, the minor has said in her petition that the accused boy was continuously harassing her. The girl repeatedly refused to follow him. She also made it clear that she has no interest in this relationship. But even after repeated refusals, he did not stop pursuing her. The court said that the victim’s evidence is sufficient to prove that the accused repeatedly harassed her with the intention of increasing personal contact, in such a situation the offence of sexual harassment under the POCSO Act will be fully applicable.

The defendant’s intention is evident – ​​High Court
The High Court said that the evidence provided by the victim is sufficient to prove that the accused was sexually exploiting her. The accused repeatedly harassed the victim even after she refused. On this the judge said that in my opinion the intentions of the accused were visible in his conduct. His intentions were not good at all.

The victim slapped the accused
According to Live Law’s report, after considering the evidence submitted by the victim, the High Court found that the victim had opposed the accused from the beginning. She also made it clear that she is not interested in this relationship. Despite this, the accused did not listen and continued to pursue her. Later, on August 19, 2017, the victim slapped the accused. Following this, an FIR was registered. Although in the court, the accused also said that he was involved in a false case, the court rejected his argument.
