The Government has notified a uniform code for marketing practices of the medical device industry in order to curb unethical practices.
In a notification, the Department of Pharmaceuticals (DoP) has asked the medical devices association to ban organising workshops abroad for healthcare professionals, offering them hotel stays or monetary subsidies.
“All associations must constitute an Ethics Committee for Marketing Practices of Medical Devices (ECMPMD), publish it on their websites along with a detailed complaints procedure, which will be linked to the UCPMP portal of the Department of Pharmaceuticals,” the notification said.
The DoP has also asked medical device companies to disclose information on the distribution of evaluation samples and expenses incurred on conferences, workshops, seminars, etc.
As part of the code, a medical device must not be promoted before receiving product approval from the regulatory authority, the notification said.
“The word safe should not be used without qualification and it should not be stated categorically that a medical device has no adverse consequences,” he said.
In addition, no medical device company or its agents should offer or provide any gift for personal benefit to any healthcare professional or their family member.
“Companies or their representatives or anyone acting on their behalf should not provide travel facilities within or outside the country to health professionals or their family members to attend conferences, seminars, workshops, etc.,” it said.
Furthermore, companies or their representatives should not provide hospitality such as hotel stays, expensive meals, resort accommodation, etc. to healthcare professionals or their family members, it added.

The DoP has asked medical device companies to upload the Uniform Code for Marketing Practices for Medical Devices (UCMPMD) 2024 on its website along with the detailed procedure for filing complaints with a link to the department’s UCMPMD portal.
Earlier this year, the DoP had notified the Uniform Code of Pharmaceutical Marketing Practices (UCPMP) 2024.
