ANI sues Netflix for copyright infringement over IC 814: The Kandahar kidnapping

It seems that the problems have no end IC 814: The Kandahar hijacking and its streaming platform Netflix.

According to a report by Bar and Bench, ANI has sued Netflix and the makers of IC 814: The Kandahar Hijack for alleged copyright and trademark infringement. ANI claims that the show uses its footage depicting then Prime Minister Atal Bihari Vajpayee, General Parvez Musharraf and terrorist Masood Azhar without a license.

According to Reuters, the news agency has demanded that four episodes of the show be removed because they used unlicensed ANI content.

Following this, Delhi HC issued a notice to Netflix and the other producers of the show.

Justice Mini Pushkarna briefly heard the matter and directed the production houses associated with the show — Matchbox Shots, Benaras Mediaworks and Netflix — to file their responses to ANI’s interim relief petition within two days. The matter will be heard on Friday.

What did ANI say?

According to the petition filed by ANI in the Delhi High Court, the show, which is currently streaming on Netflix, uses video content belonging to the news agency. Some of the footage used in the show includes scenes featuring Prime Minister Atal Bihari Vajpayee, General Parvez Musharraf and terrorists Masood and others. ANI claims that the footage was used without proper license.

According to Bar and Bench, lawyer Siddhant Kumar, who appeared for the news agency, argued that they do not want to be associated with a show which exonerates Pakistan of its role in the hijacking and is now being described as a public relations exercise by Pakistan’s spy agency ISI.

The lawyer further revealed that the producer of the show approached ANI with a request to use its images in the year 2021, but there was no agreement between the two parties. He also said that one of the images shows ANI’s logo, which constitutes trademark infringement.

“This show is not only controversial but anti-national and unpatriotic in the eyes of the public. I don’t want to be associated with them… Four of the six episodes use my footage extensively. I hired a cameraman in Pakistan who possibly has the only shot of Masood Azhar being released in Pakistan,” Kumar stressed.
