DWTS’ Artem Chigvintsev seeks spousal support and custody in divorce from Nikki Garcia

Artem Chigvintsev is seeking spousal support and joint custody of Nikki Garcia’s son, who recently filed for divorce following his arrest for domestic violence.

According to documents filed on Friday, Artem Chigvintsev has requested spousal support from his ex-wife, Nikki Garcia. In addition, he has also asked Garcia to pay for his lawyer and legal fees. The documents also indicate that the Dancing With the Stars professional dancer has requested joint legal and physical custody of their 4-year-old son Matteo.

Legal battle between Chigvinstev and Garcia

Garcia filed for divorce on Friday two weeks after Chigvinstev was arrested on charges of Domestic violence in California. The documents indicate the reason divorce as irreconcilable differences and the date of separation was August 29, which was the same day the incident occurred. The retired WWE star also requested sole legal and physical custody of their 4-year-old son with visitation rights for her ex-husband when she filed for divorce.

Chigvinstev was arrested at his Napa Valley home last month after making a desperate call asking for medical assistance at his residence. He later called to cancel the request, but officers showed up at his home. The Napa County Sheriff’s Office public information officer revealed to Page Six, “In a domestic violence case, if someone picks up the phone and says, ‘You don’t have to come after all,’ we’re still going to request a welfare check. We’re not going to stop doing what we’re doing.”

Police examined the scene and then sent the professional dancer to the Napa County Jail on charges of domestic violence. Under California Penal Code Section 273.5(a), it is illegal to cause “injury resulting in a traumatic condition” to a spouse, ex-spouse, cohabitant or anyone with whom the abuser had a romantic relationship at any time. He was released after a few hours on bail that cost him $25,000.

The ‘volatile’ marriage of Chigvinstev and Garcia

The domestic violence occurred shortly after the couple celebrated their second anniversary in August. On an August 28 Nikki & Brie Show podcast episode, Nikki expressed that she was looking forward to spending time with her husband in a time-lapse and talking about their marriage. She explained, “Where are we at? What do you like and what don’t you like? We had a great conversation and we didn’t set goals for the next few years of marriage, but [figuring out] What things can we add to our marriage or what do we expect from our marriage?

Sources close to the former couple revealed to TMZ that the recent developments are not surprising given that their marriage was always “volatile.” The couple tied the knot in August 2022 and welcomed their son in August 2020.
