Dispute between husband and wife: A Mumbai court has granted anticipatory bail to a man accused of giving champagne to his 10-year-old autistic son. This accusation was made by the man’s wife, who lives separately from him and divorce proceedings are ongoing. There is also a legal battle between the two for custody of their son.
The incident is said to have taken place in June 2022, when the man was celebrating his son’s birthday at a restaurant in Mumbai. The wife claims that during that time they gave the child champagne, while the husband described it as a fruit drink. The matter became more serious when the husband’s mother appealed against his last wish before the Bombay High Court, following which the wife lodged an FIR with the police.
The accused was granted anticipatory bail.
The husband’s lawyer, Swapan Kode, termed the allegation revenge and demanded bail, which was accepted by the court. Justice Sunil Patil ruled that the FIR was lodged late and the child had not suffered any side effects. Citing possible revenge, the court granted anticipatory bail to the accused.
Fruit drink, not champagne: man’s lawyer
Lawyer Swapna Kode, representing the man, opposed the custody suit, stating that the boy was not given champagne but fruit drink. Further, Kode said that the case against his client was filed only out of revenge as his mother had approached the Bombay High Court to make his father’s last wish. Kode also raised before the court the fact that the woman had also earlier approached the Child Welfare Committee (CWC) in Raigarh raising the same issue.
CWC reprimanded parents
But CWC had reprimanded both parents (the woman and her husband) for fighting like this, after which the woman withdrew the complaint. After hearing both sides, Justice Sunil Patil observed that the FIR against the man was lodged very late and the boy had told the CWC that he had not experienced any side effects after drinking the liquid. One side calls it sorbet and the other side calls it champagne. While not ruling out the possibility of lodging a revenge FIR in the case, the court granted anticipatory bail to the person.
