Delhi government prepares to approach Supreme Court

AAP: Once again, the conflict between the Delhi government and the Lieutenant Governor seems to be escalating over rights in Delhi. The Aam Aadmi Party is once again gearing up to challenge in the Supreme Court the Union Home Ministry’s decision to increase the powers of the Lieutenant Governor. In the gazette released by the Home Ministry late on Tuesday night, the Lieutenant Governor has been given the right to constitute any authority, board, commission and statutory body. After this notification, the rights debate between the Delhi Government and the Lieutenant Governor is likely to intensify once again. Hearing the Delhi government’s petition, the Supreme Court had said that the Centre will have authority over police, land and law and order, while the elected government can take decisions on all other matters. The Delhi government was also given the right to appoint and transfer officials. After this decision, Parliament passed the Government of Delhi (Amendment) Bill, 2023. In this Act, many types of powers were given to the Lieutenant Governor of Delhi.

What is the reason for the dispute?

For the first time, assembly elections were held in Delhi in the year 1952 and Chaudhary Brahm Prakash became the Chief Minister. At that time, Delhi had the status of a full state. But after the formation of the State Reorganisation Commission in the year 1956, Delhi became a Union Territory. In the year 1991, the Legislative Assembly was formed in Delhi but it was not given the status of a full state. By making the 69th amendment to the Constitution, Delhi was given the status of a National Capital Territory and Section 239 AA was added to the Constitution. It was provided in this that in case of any dispute between the Government of Delhi and the Lieutenant Governor, only the decision of the President would be valid. According to this act, work continued smoothly in Delhi till 2013. But after the formation of the common man’s government, the dispute increased and continues till now.
