Excise policy case: SC declines interim relief to Arvind Kejriwal, seeks reply from CBI by Aug 23

He Supreme Court On Thursday (August 14), the Indian government refused to grant interim relief to Delhi Chief Minister Arvind Kejriwal in a money laundering case related to an alleged excise tax policy case.

“We will not grant interim relief,” the apex court observed despite requests from From Kejriwal lawyer for provisional bail on health grounds. The court also issued a a notice to the Central Bureau of Investigation (CBI) on Kejriwal’s petition against his arrest and sought a response by August 23.

A bench of Justices Surya Kant and Ujjal Bhuyan was hearing Kejriwal’s petition against the Delhi High Court order confirming his arrest by the CBI and his application for bail.

Kejriwal’s lawyer Abhishek Manu Singhvi told the court that the CBI’s action was an “insurance arrest” as Kejriwal was on the verge of getting bail in the most stringent PMLA case from the ED. The central agency had last questioned Kejriwal a year before his arrest.

On August 5, the High Court upheld the legality of the prime minister’s arrest and said there was no malice in the minister’s actions.

CBI which showed how the AAP supremo could influence witnesses who could only muster the courage to testify after his arrest.

The high court had asked him to request the trial court to grant regular bail in the CBI case.

Kejriwal, who was arrested by the ED on March 21, was granted bail by the trial court in the money laundering case on June 20. However, the trial court’s order was stayed by the high court.

On July 12, the Supreme Court granted him bail in the money laundering case.

The excise policy was scrapped in 2022 after the Lieutenant Governor of Delhi ordered a CBI probe into alleged irregularities and corruption related to the formulation and execution of the excise tax policy.

The CBI and the Education Department claimed that irregularities were committed in changing the excise policy and undue favours were given to licensees.
