The Supreme Court on Tuesday granted bail to BRS leader K Kavitha and asked the ED and CBI to show what “material” they had to prove that she was involved in the alleged Delhi excise policy scam. A bench of judges comprising Justices BR Gavai and KV Viswanathan was hearing Kavitha’s bail pleas in the corruption and money laundering cases linked to the alleged scam that are being investigated by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED), respectively.

Senior advocate Mukul Rohatgi, appearing for Kavitha, sought bail and said the two agencies had already completed their investigation against her. He also referred to the Supreme Court verdict granting bail to AAP leader Manish Sisodia, a co-accused in the two cases.

Additional solicitor general SV Raju, appearing for the investigating agencies, claimed that Kavitha had destroyed and formatted her mobile phone and that her conduct amounted to tampering with evidence. Rohatgi called the allegation “false”.

“What material is there to prove that she was involved in the crime?” the court asked Raju. The hearing in the matter is underway. On August 12, the top court had sought responses from the CBI and the ED on Kavitha’s allegations challenging a July 1 Delhi High Court order denying her bail in the two cases.

The apex court had dismissed Kavitha’s bail applications in both cases, saying she was prima facie a key conspirator in the criminal conspiracy relating to the formulation and implementation of the now-scrapped Delhi Excise Policy 2021-22.
