Madras High Court orders Tennessee veterinary college not to reject transgender person’s application based on identity

The Madras High Court has ordered a veterinary college not to reject the application of a female candidate for an undergraduate course on the grounds that she is transgender.

Justice M. Dhandapani passed judgment in a recent order, disposing of a petition by A. Nivetha, challenging the prospectus issued by Tamil Nadu University of Veterinary and Animal Sciences (TANUVAS) for notification of admission to undergraduate degree programmes 2024-2025. The petition sought its quashing as illegal inasmuch as it did not categorise transgenders under a special category.

The judge said that though the petitioner’s counsel raised many grounds, when the matter came up for hearing, the counsel held that it would be sufficient for the court to direct the university to consider Nivetha’s application dated June 26, 2024, and place her appropriately, if she got the post on merit.

The lawyer appearing on behalf of the University has no serious objection to the filing, the judge added.

In view of the limited application made by the counsel appearing for the petitioner, without interfering with the impugned admission notification issued by the university, the court directed TANUVAS to consider the application of Nivetha and accommodate her appropriately within a period of two weeks.

“It is clear that the third respondent (the University) will not reject the petitioner’s application on the grounds of being transgender,” the judge added.
