Malaysian component got relief from Supreme Court

Kolkata: State Labour and Law Minister Malay Ghatak has got a major relief from the Supreme Court. The top court has dismissed the petition filed by ED against Malay Ghatak. A bench comprising Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra on Friday questioned why the central investigation agency approached the Supreme Court after 181 days. ED had moved the Delhi High Court demanding to question Malay Ghatak in Delhi. The High Court dismissed the petition and said that the Supreme Court had given permission to question Abhishek Banerjee in Kolkata in the coal smuggling case, so the ED should also question Malay Ghatak in Kolkata. The Central Investigation Agency has approached the Supreme Court against this order of the High Court. Malay Ghatak had approached the Delhi High Court demanding protection in the coal smuggling case. He also requested that he be called to the ED office in Kolkata for questioning instead of Delhi. On September 5, 2023, the Delhi High Court said that ED can question Malay Ghatak at its Kolkata office.

The central probe agency can issue a 24-hour notice to the state Law Minister for appearance. The ED had approached the Supreme Court alleging that parts of the Delhi High Court order gave unfair advantage to the Malays. But due to the delay, the apex court on Friday rejected the petition and reprimanded the ED.
