Maliwal assault case: Delhi Police urges Supreme Court to reject accused Bibhav Kumar’s bail plea

New Delhi: Delhi Police on Thursday termed the alleged physical assault on the AAP Rajya Sabha MP Swati Maliwal in the Prime Minister Arvind KejriwalThe man’s residence was termed “brutal” and urged the Supreme Court to dismiss the bail application of accused Bibhav Kumar in the case.

Delhi Police, in its response to the bail application of Kumar, an aide to the Prime Minister Arvind KejriwalHe also asked the high court to hear Maliwal in the case as well.

Kumar, who is currently in judicial custody, is accused of assaulting Maliwal on May 13 at Kejriwal’s official residence and has challenged the Delhi High Court’s July 12 order denying him bail.

“The present case is a case relating to brutal assault on a sitting Member of Parliament by a former influential officer at the residence of the Prime Minister, wherein the incident also occurred at the residence of the Chief Minister of Delhi… and such incident has had a grave impact on the minds of the general public and any sentence in the said case will have a cascading effect on the minds of the general public,” said an affidavit filed by Deputy Commissioner of Police Manoj Kumar Meena.

The affidavit said the accused is an “influential person” compared to the victim and “the present case requires that the plaintiff be heard as any liberty granted to the accused plaintiff in this case directly affects her safety and well-being as well as that of her family members.”

He said the victim also confirmed her complaint in her statement before a judicial magistrate.

“It is important to note that the victim was deeply traumatised by the harassment and assault she faced. Moreover, the victim is a respected Member of Parliament from a ruling party in Delhi and was brutally attacked at a highly sensitive location, the residence of the Hon’ble Chief Minister.

“This serious incident significantly affected her mental state, forcing her to remain housebound for four days following the assault,” the affidavit states.

The court headed by Justice Surya Kant is hearing the case. On August 1, the court had made some strong observations on the alleged offence and the accused.

On May 16, a case was registered against Kumar under various provisions of the Indian Penal Code, including those related to criminal intimidation, assault or use of criminal force against a woman with intent to disrobe her and attempt to commit culpable homicide. He was arrested on May 18.

While denying him bail, the top court had said that the accused enjoys “considerable influence” and had not made out any argument for granting him bail. It cannot be ruled out that witnesses may be influenced or evidence may be tampered with in case the petitioner is released on bail, the top court had said.
