The Supreme Court on Friday allowed final-year law students to appear for the All India Bar Examination (AIBE). The exam is scheduled to be held on November 24, 2024.
The interim order was passed by the Supreme Court while hearing a petition challenging the Bar Council of India (BCI) decision to exclude final-year law students from registering for the examination.
During the hearing before the bench comprising Chief Justice DY Chandrachud, Justices JB Pardiwal and Manoj Misra, the Bar Council of India contended that it needed time to frame rules regarding registration of final-year law students for the examination. The court said they could take time to frame rules but they should ensure that final-year law students do not lose a year.
“We order that the BCI shall permit the enrolment of all students who fall within the scope of paragraph 38 of the Bonnie Foi decision. The above order shall come into effect in the case of AIBE on November 24,” the court observed in the order.
The petition filed by Nilay Rai and eight other final-year LLB students challenged the Bar Council of India (BCI) notification restricting final-year LLB students from taking the All India Bar Examination (AIBE).
A law graduate must pass the AIBE test in order to be registered as a lawyer at a state bar. The petition claimed that the notification would lead to the loss of valuable time in developing a professional career if final-year students were barred from taking the test.
