The Supreme Court is scheduled to hear Chief Minister Arvind Kejriwal’s petition on August 14 against his arrest by the Central Bureau of Investigation (CBI) in connection with the excise policy scam case. The hearing comes in the wake of the Delhi High Court’s decision to uphold his arrest. The apex court will also consider Kejriwal’s bail plea separately.
Court of Justice that he will preside over
The case will be presided over by Justices Surya Kant and Ujjal Bhuyan. The Supreme Court agreed to list Kejriwal’s petition on the urgent list after senior advocate Abhishek Singhvi sought immediate attention to the matter.
The High Court decision confirmed the arrest
On August 5, the Delhi High Court upheld the legality of Kejriwal’s arrest and rejected allegations of malafide in the CBI’s actions. The court highlighted that Kejriwal’s influence over witnesses necessitated his arrest, which subsequently led to key testimonies. The High Court advised Kejriwal to apply for regular bail through the trial court.
Background of the case
The excise policy, which was scrapped in 2022 following a probe ordered by the Delhi lieutenant governor, has been at the centre of controversy. Both the CBI and the Enforcement Directorate (ED) allege that irregularities and undue favours were granted during the modification and implementation of the policy. The Supreme Court hearing on August 14 will be crucial in determining the next steps in the legal battle.
