Supreme Court refuses to stay Telangana post-grade 1 exam, says it will lead to chaos

The Supreme Court on Monday refused to stay the examination being conducted by the Telangana Public Service Commission (TGPSC) to fill up 563 Grade 1 posts in various government departments, saying such an order would lead to “chaos”.

“The exam will begin at 2 pm… There will be chaos if we suspend the exam at this stage,” a bench comprising Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra had said during the previous hearing, when senior advocate Kapil Sibal, appearing for a petitioner, pressed for an interim stay.

“The students have already entered the examination centers,” the court stressed.

The court noted in its order: “Any interim order would lead to substantial disruption of the conduct of the examination, something we are not willing to do.”

Sibal claimed that the aspirants would lose the opportunity to appear for the exam which is being held for the first time in the state.

Sibal, from the beginning, requested a provisional suspension of the holding of the exams.

The examination is being held after 14 years, he said, adding that the reorganization was carried out in 2014.

“These are Group 1 posts and they will never be filled again. I am only asking for an adjournment,” the senior counsel urged the court.

The CJI, however, said: “How can we postpone it? It will be extraordinary for us to do so.”

The court, however, asked the high court to consider the matter before declaration of results and said the results will be subject to the final outcome of the challenge.

“The High Court has specified that any selection made for Group 1 services will be subject to the final outcome of the process. The process is scheduled before the High Court on November 20,” the high court ordered.

The Group 1 main exam conducted by the TGPSC began on Monday and will continue till October 27 for all 563 vacancies.

A total of 31,383 candidates have qualified for the main exam. These exams were held for the first time since the formation of Telangana and in 2011 when they were last conducted.

The quota policy, which is being followed by the TGPSC under a government order (GO), has been challenged in the high court by one Pogula Rambabu.

Candidates have been protesting against the GO seeking to reschedule the exams on the grounds that SCs (scheduled castes), STs (scheduled tribes) and backward classes suffer under its reservation provisions.
