U.S. Citizenship and Immigration Services (USCIS) has revised its policy guidelines for optional practical training (OPT) for international students in science, technology, engineering, and mathematics (STEM) fields. The updates, which went into effect on August 27, provide much-needed clarity and expanded opportunities for students currently studying in the United States or planning to do so.
Key changes
Expanded OPT for STEM Students: International students in science, technology, engineering, and mathematics (STEM) fields can now benefit from up to three years of OPT, compared to just one year for students in non-STEM fields. This extension allows students to gain work experience in the U.S. after graduation.
Online Study Grants: Students may count one online class or up to three credits per academic session toward the full course of study requirement without violating the terms of their F1 visa. This provides flexibility for students who opt for distance learning.
School transfers and changes in educational level: The updated policy allows students to transfer between ICE-certified SEVP schools at the same educational level or change between different levels. This streamlines the process for students looking to change their academic path.
60-Day Grace Period Flexibility: After completing their OPT, students have a 60-day grace period to change their educational level, transfer to another SEVP-certified school, or apply for a different immigrant or nonimmigrant status. Employers may also sponsor the student’s H-1B visa during this period.
STEM OPT extension application period clarified: The revised guidance corrects the timeline for applying for STEM OPT extensions, ensuring that students understand when to submit their applications.
Study Abroad Program Guidelines: Students enrolled in SEVP-certified schools may maintain their active status in the Student and Exchange Visitor Information System (SEVIS) during study abroad programs that last less than five months. For longer programs, a new Form I-20 will be required.
What students need to do
For those applying for the STEM OPT extension, the following are required:
- Valid OPT period after termination.
- A qualifying STEM degree from an accredited institution.
- Employment with an employer enrolled in E-Verify.
Students must also make sure their information is up to date and report any changes to their legal name, address, or employment status within 10 days. Even if there are no changes, students must confirm their information every six months.
